Your AI-Built Website Needs an AI Content Label. Three New Laws Require It
September 3, 2026
Someone asked me recently, “If I used an AI tool to build my website, do I need to tell visitors?”
If your website contains AI-generated copy, images, audio, video, chatbot responses, or heavily edited media, the safe answer is yes.
Three major transparency regimes now affect how synthetic content is identified:
- EU AI Act Article 50
- India IT Rules 2026 and SGI labelling
- California AI Transparency Act
The exact legal duty depends on your location, audience, website size, content type, and whether you provide or simply use an AI system. A small business website is not treated the same as a large AI platform.
However, the practical standard is becoming clear: make AI involvement visible to people and detectable by machines.
That matters for compliance, customer trust, answer engine optimization, and AI search optimization.

Why AI content disclosure matters for a fast-built website
AI-assisted website builders help solo founders and indie hackers launch quickly. The problem is that speed can hide unfinished details.
You may have:
- AI-written service pages
- AI-generated blog articles
- AI-created product images
- Synthetic voiceovers or videos
- A chatbot answering customer questions
- Images edited heavily with generative tools
- A website template that added content without explaining its origin
Visitors may not object to responsible use of these tools. They may object when the site appears to hide it.
Trust is the first issue. Customers want to know whether a testimonial image is real, whether a product demonstration actually happened, and whether a support conversation involves a person.
Search visibility is the second issue. Search engines and answer engines increasingly look for clear context, reliable sources, editorial responsibility, and transparent content practices. A disclosure does not guarantee rankings or citations, but unexplained synthetic media can create uncertainty.
Compliance is the third issue. A label alone will not satisfy every rule. Some laws also refer to metadata, provenance records, identifiers, or machine-readable markers.
The practical contrast
| ❌ Weak approach | ✅ Better approach |
|---|---|
| Publish AI-generated images without explanation | Add a clear label near the image |
| Hide synthetic video behind a normal thumbnail | State that the video is synthetically generated |
| Assume a human-edited article needs no disclosure anywhere | Record your editorial process and disclose where required |
| Add visible text but remove all metadata | Preserve machine-readable provenance where technically feasible |
| Treat compliance as separate from SEO | Include transparency in your website SEO audit and AEO workflow |
The three laws compared
The laws do not all regulate the same people or the same content. Use this table as a practical starting point, not as legal advice.
| Law | Who it applies to | What must be labelled or marked | What the marker looks like |
|---|---|---|---|
| EU AI Act Article 50 | Providers and deployers of certain AI systems operating in or serving the EU | AI interactions, deepfakes, and certain AI-generated public-interest text. Providers also have machine-readable marking duties for synthetic outputs | Clear notice such as “You are interacting with an AI system” or “AI-generated content,” plus machine-readable marking or provenance where required |
| India IT Rules 2026, SGI | Intermediaries that enable, publish, share, or distribute synthetically generated information, with stronger duties for significant social media intermediaries | Realistic synthetic audio, visual, and audiovisual content. Text-only output is generally outside the SGI definition | Prominent visible “Synthetically Generated” or similar notice, plus permanent metadata or a unique identifier where technically feasible |
| California AI Transparency Act | Covered generative AI providers publicly accessible in California that meet the required visitor or user threshold | AI-generated or altered images, video, audio, and combinations of those formats | A clear manifest disclosure option for users, plus latent provenance data that can be detected by the provider’s free detection tool |
A non-developer compliance playbook
Run these steps before sending traffic to your website or launching a new campaign.
1. Check your site for disclosure and security problems
Run the free Smart Analytics Vulnerability Check and review the SGI and AI compliance score.
The check looks for:
- Visible AI disclosure labels
- Machine-readable AI content markers
- Schema.org
creativeWorkStatussignals - C2PA content credentials or provenance metadata
- Disclosure statements visible to visitors
- Security headers and exposed files
- Leaked credentials or API keys
- Outdated libraries and other common vulnerabilities
This is important for vibe-coded websites because a site can look polished while still containing exposed files, unsafe settings, or missing compliance signals.
2. Add a visible label beside AI-generated content
Open your website editor and add a short disclosure near each relevant image, video, audio player, chatbot, or article.
Do not place one generic sentence in the footer and assume the job is complete. The label should travel with the content when possible.
For an image, place the notice below the caption. For a video, keep the notice visible in the player or thumbnail. For a chatbot, display the notice before the first interaction.
3. Add machine-readable markers
Use the free Meta Tag Generator and Schema Markup Generator to create copy-paste metadata and structured data.
For relevant creative work, include a clear creativeWorkStatus value such as:
{
"@type": "ImageObject",
"name": "Product demonstration image",
"creativeWorkStatus": "AI-generated",
"caption": "AI-generated image"
}
Use this as an additional signal, not as a replacement for legally required provenance systems. Some laws and platforms may require permanent metadata, content credentials, provider identifiers, or watermarking that ordinary website markup cannot provide.
If you use an AI website builder, check whether it preserves image metadata and disclosure settings when exporting or compressing files.
4. Generate copy-paste repair instructions
If you are not comfortable editing HTML, use the AI Fix Prompt generator after the audit.
It creates fix instructions based on your actual findings, including:
- Missing visible labels
- Missing schema
- Missing meta tags
- CMS-specific implementation steps
- AEO and SEO issues
- Security warnings
- Copy-paste code requests
Paste the prompt into your coding assistant or website builder. Ask it to make one change at a time, then review the result yourself.
5. Re-check the site
Run the check again after publishing the changes.
Confirm that:
- The label appears on the live page
- The label is readable on mobile
- The content has the correct structured data
- The page source includes the intended marker
- Images still retain provenance metadata where available
- Your chatbot identifies itself before interaction
- No new security issue appeared during deployment

Finish your launch with a free audit
Your website does not need to be perfect before you launch. It does need a final check.
Smart Analytics provides a completely free website SEO audit, AEO audit, vulnerability scan, and SGI compliance check. There is no login, no email requirement, no paywall, and no reduced report. You receive the full report every time.
Use the free SEO audit tool, then review the full feature list for the Meta Tag Generator, Schema Markup Generator, Robots.txt Generator, llms.txt Generator, Search Console Regex Library, AI Fix Prompt generator, and Vulnerability Check.
Specific vulnerability findings remain private in the downloadable PDF. Results are created in your browser, so you can keep the report for yourself or share it with a developer.
Add the label. Preserve the marker. Re-check the live site.
That small task can protect trust, improve content clarity, and make your fast-built website ready for the next stage of search.
